conciliation

Conciliation is an alternative dispute resolution (ADR) process whereby the parties to a dispute use a conciliator, who meets with the parties both separately and together in an attempt to resolve their differences. They do this by lowering tensions, improving communications, interpreting issues, encouraging parties to explore potential solutions and assisting parties in finding a mutually acceptable outcome.

Onder conciliatie wordt een vergaderronde van het Europees Parlement met de Europese Ministerraad en de Europese Commissie bedoeld. Als de Europese Commissie een voorstel doet voor Europese wetgeving, wordt dit in het Europees parlement behandeld. Dit wordt de eerste lezing genoemd. Als het Europees parlement het met het voorstel eens is, wordt het doorgevoerd. Als het Europees parlement het niet met de regeling eens is, zal het amendementen indienen. De Europese Commissie wijzigt het voorstel, waarna het Europees parlement het in tweede lezing kan goedkeuren.

La conciliation est une procédure dite encore "mode alternatif de règlement des litiges" visant à un accord des parties opposées par un litige avant l'intervention d'une décision potentiellement contraignante. Elle peut être prévue par un accord d'entreprise ou par une convention collective, sinon elle est de nature législative ou réglementaire. La principale différence entre la conciliation et la médiation est que le conciliateur est un citoyen bénévole alors que la médiation est une activité rémunérée, le médiateur étant un professionnel de cette procédure.
