Passing off
In common law countries such as England, Australia and New Zealand, passing off is a common law tort which can be used to enforce unregistered trade mark rights. The tort of passing off protects the goodwill of a trader from a misrepresentation.

גניבת עין
גניבת עין היא עוולה נזיקית המתבצעת עת אדם מנסה להבנות מהמוניטין של בעל מוצר או שירות כלשהו באמצעות הטעיית הציבור לחשוב שמקור המוצר או השירות של המתחזה הוא בעל המוניטין. גניבת העין פוגעת בבעל המוניטין אשר השקיע ביצירת המוניטין בכך שהיא נוגסת במכירות שלו ולעתים, כאשר המוצר או השירות המתחזה אינו עומד ברמה של בעל המוניטין, בכך שהיא פוגעת במוניטין שלו.
