derogation

Derogation is the partial revocation of a law, as opposed to abrogation or the total abolition of a law. The term is used in both civil law and common law. It is sometimes used, loosely, to mean abrogation, as in the legal maxim: Lex posterior derogat priori, i.e. a subsequent law imparts the abolition of a previous one.

Als Derogation (lat. derogare = 1. absprechen, entziehen 2. teilweise abschaffen) werden in der Rechtssprache verschiedene Vorgänge bezeichnet, mit denen geltendes Recht durch eine andere Regelung ersetzt wird.

Derogatie is een term uit het recht om de buitenwerkingstelling van een rechtsnorm te beschrijven. Derogatie wordt enerzijds gebruikt om wettelijke bepalingen af te schaffen (soms ook abrogatie genoemd) en anderzijds in geval van conflicterende rechtsregels te bepalen welke rechtsregel prevaleert (de eigenlijke derogatie). Voor beide vormen van derogatie kan men daarnaast onderscheid maken in formele en materiële derogatie.

Une dérogation est la révocation partielle d'une loi, par opposition à l'abrogation ou abolition totale de cette loi. Le terme est utilisé autant en droit civil qu'en droit canon. Il est parfois communément employé pour signifier abrogation, comme dans la maxime juridique : Lex posterior derogat priori, i.e. une loi subséquente implique l'abolition d'une loi plus ancienne.

Derogacja (uchylenie, z łac. derogatio) – uchylenie części normy prawnej i zastapienie jej nową.  Abrogacja – uchylenie "czyste", całkowite zniesienie normy prawnej bez zastępowania jej nową.
