Jurisprudence is the social science, study and theory of law. It includes principles behind law that make the law. Scholars of jurisprudence, also known as jurists or legal theorists (including legal philosophers and social theorists of law), hope to obtain a deeper understanding of the nature of law, of legal reasoning, legal systems and of legal institutions. Modern jurisprudence began in the 18th century and was focused on the first principles of the natural law, civil law, and the law of nations. General jurisprudence can be divided into categories both by the type of question scholars seek to answer and by the theories of jurisprudence, or schools of thought, regarding how those questions are best answered. Contemporary philosophy of law, which deals with general jurisprudence, addresses problems in two rough groups:

1. Problems internal to law and legal systems as such.
2. Problems of law as a particular social institution as it relates to the larger political and social situation in which it exists.

Die Rechtsphilosophie ist ein Teilgebiet der Philosophie und Grundlagendisziplin der Rechtswissenschaft, die sich mit den grundlegenden Fragen des Rechts befasst. Rechtsphilosophische Fragestellungen sind beispielsweise:

• Was ist Recht?
• In welchem Verhältnis stehen „Gerechtigkeit“ und „Recht“ zueinander?
• In welchem Verhältnis stehen Rechtsnormen zu anderen sozialen Normen, insbesondere zur Moral?
• Welchen Inhalt sollte das Recht haben?
• Wie entstehen Rechtsnormen?
• Was ist der Grund für die Geltung des Rechts? (Verbindlichkeit)
• In welchem Verhältnis stehen „Rechtsgefühl“ und „Recht“ zueinander?

Rechtsfilosofie is een onderdeel van de filosofie dat specifieke vragen tracht te beantwoorden met betrekking tot het recht. Deze vragen kunnen zijn:

• Wanneer moet men aan recht gehoorzamen?
• Waarom zijn wij aan recht gebonden?
• Tot welke grens mag de overheid zich met het leven van de burgers bemoeien?
• In hoeverre is het recht een machtsinstrument?
• Hoe kan juridische dwang gerechtvaardigd worden?
• Wat is de aard van het recht?

La philosophie du droit (à ne pas confondre avec la théorie du droit, distinction opérée notamment par Hans Kelsen dans la Théorie pure du droit) est l'étude et l'analyse des concepts et principes fondamentaux du droit et des lois. Discipline située à l'intersection entre philosophie, études juridiques et sciences politiques, elle est désignée, en anglais, sous le nom de « jurisprudence » ou de « legal theory ». Parmi les principaux courants de la théorie du droit, on peut citer le positivisme juridique, dont Hans Kelsen (1881-1973) a fourni les titres de noblesse, le droit naturel (Ronald Dworkin), le réalisme (le juge Oliver Holmes aux États-Unis ou Axel Hägerström en Suède), qui se rapproche parfois de la sociologie du droit, en mettant l'accent sur les pratiques effectives des acteurs juridiques. En France, la discipline est représentée en particulier par Michel Villey (1914-1988), Michel Troper, Paul Amselek ou Jean-François Kervégan.
